California Privacy Rights
Notice for California residents pursuant to the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), Cal. Civ. Code §§ 1798.100–1798.199.100.
Effective date: 1 January 2025
01. Scope
This California Privacy Rights notice supplements the PersonaX Privacy Policy and applies solely to visitors, users, and clients who reside in the State of California. It describes your rights under CCPA as amended by CPRA and how PersonaX handles California personal information.
02. Categories of Personal Information Collected
In the preceding 12 months PersonaX has collected the following categories of personal information from California consumers:
A. Identifiers
- Real name, alias, email address, company name
- Source: directly from you at account creation
- Business purpose: service delivery, invoicing, account management
B. Sensitive Personal Information — Biometric Data
- Voice samples, voice frequency patterns, synthetic voice profile
- Facial geometry, face reference video recordings, digital avatar profile
- Source: collected during the digital twin onboarding flow with your explicit consent
- Business purpose: creation and operation of your AI voice clone and digital avatar for approved content production only
C. Commercial Information
- Subscription plan, billing records, payment status (card numbers processed by İyzico A.Ş., not stored by PersonaX)
- Source: collected during checkout and subscription management
- Business purpose: billing, tax compliance, financial reporting
D. Internet / Network Activity
- IP address, browser type, operating system, session timestamps, pages viewed
- Source: collected automatically via server logs and optional analytics cookies
- Business purpose: security, platform performance, optional usage analytics
E. Professional and Employment Information
- Job title, company, industry, professional credentials
- Source: provided during onboarding and profile setup
- Business purpose: personalizing content strategy and scripts
F. Inferences
- Content preferences, brand tone, audience profile derived from onboarding inputs
- Source: derived internally from information you provide
- Business purpose: personalising content production
03. Do We Sell or Share Personal Information?
No. PersonaX does not sell personal information as defined under Cal. Civ. Code § 1798.140(ad)(1), and does not share personal information for cross-context behavioral advertising as defined under § 1798.140(ah). We share personal information only with service providers under written contracts that prohibit independent use.
04. Use of Sensitive Personal Information
PersonaX uses Sensitive Personal Information (biometric voice and face data) only to:
- Provide the AI digital twin content production services you have contracted for
- Maintain the security and integrity of the platform
- Comply with legal obligations
- We do not use SPI to infer characteristics about you unrelated to the requested service.
05. Your California Privacy Rights
As a California resident, you have the following rights under CCPA/CPRA:
Right to Know (§ 1798.110)
You have the right to request that PersonaX disclose: the categories and specific pieces of personal information collected about you; the categories of sources; the business purpose for collection; and the categories of third parties with whom it is shared.
Right to Delete (§ 1798.105)
You have the right to request deletion of personal information collected from you, subject to certain exceptions (e.g., completing a transaction, security, legal obligation). PersonaX will fulfill verified deletion requests within 45 days.
Right to Correct (§ 1798.106)
You have the right to request correction of inaccurate personal information. PersonaX will correct verified requests within 45 days.
Right to Opt-Out of Sale/Sharing (§ 1798.120)
You have the right to opt out of the sale or sharing of your personal information. PersonaX does not sell or share personal information, so this right is already effectively exercised. If this ever changes, we will update this notice and provide a 'Do Not Sell or Share My Personal Information' mechanism.
Right to Limit Use of Sensitive Personal Information (§ 1798.121)
You have the right to direct PersonaX to limit its use of your biometric data to that which is necessary to provide the services you requested. To exercise this right, contact support@mypersonax.com.
Right to Non-Discrimination (§ 1798.125)
PersonaX will not discriminate against you for exercising any of your CCPA/CPRA rights. We will not deny services, charge different prices, or provide a lower quality of service based on your exercise of privacy rights.
06. How to Submit a Privacy Request
To exercise your CCPA/CPRA rights, submit a verifiable consumer request to:
- Email: support@mypersonax.com — include your full name and the email address on your PersonaX account
- We will verify your identity before processing any request
- Response time: within 45 days of receiving a verifiable request (extendable by 45 additional days where necessary, with prior notice)
- You may designate an authorized agent to submit a request on your behalf with written authorization
- We will respond to requests free of charge, up to twice per 12-month period
07. Financial Incentives
PersonaX does not offer financial incentives in exchange for the collection, retention, or sale of personal information under Cal. Civ. Code § 1798.125(b).
08. Contact the California Privacy Protection Agency
If you believe your CCPA/CPRA rights have been violated, you may file a complaint with the California Privacy Protection Agency (CPPA) at cppa.ca.gov or with the California Attorney General at oag.ca.gov/privacy.
09. Updates to This Notice
This notice is reviewed at least annually. The current version is always available at mypersonax.com/california-privacy-rights. Material changes will be communicated by email.
